HIPAA Penalties Can Reach $1.5 Million a Year for Uncorrected Violations
The U.S. Department of Health and Human Services' Office for Civil Rights (OCR) enforces HIPAA's Privacy and Security Rules, and its penalties for noncompliance go well beyond a warning letter.
Penalties fall into the following four tiers:
An unknowing violation runs $100 to $50,000 per incident.
Reasonable cause runs $1,000 to $50,000.
Willful neglect that gets corrected within 30 days still runs $10,000 to $50,000 per violation.
Willful neglect that is not corrected in time carries a flat $50,000 per violation, with an annual maximum of $1.5 million.
"The secretary is prohibited from imposing civil penalties (except in cases of willful neglect) if the violation is corrected within 30 days." — American Medical Association
The scariest part for healthcare leaders? Skilled Nursing Facilities and Long-Term Care organizations that transmit claims electronically are covered entities under HIPAA, and in some cases, individual directors, employees, or officers can be held personally liable, not just the organization.
For administrators, the tiers matter more than the topline numbers. The gap between corrected within 30 days and willful neglect, uncorrected, is the difference between a manageable fine and six figures. Staff training and a clear incident response plan are what keep a facility on the right side of that line.
The key to successfully mitigating any emergency is preparedness. CHUG members have access to a comprehensive suite of educational workshops that utilize real-life case studies to teach effective responses to storms and emergency situations. This training can be lifesaving. Not a member? Become a member today. Already a member? Visit the Member Portal for a full calendar of events and member-exclusive content.
