Automation Causes $2.4 Million Class Action Lawsuit for NY Nursing Home
A nursing home in New York has tentatively agreed to a $2.4 million settlement in a class-action lawsuit alleging it automatically deducted unpaid lunch periods from employee paychecks even when the workers had not actually taken those breaks.
“The proposed class includes any licensed practical nurse, nursing assistant, personal care assistant or registered nurse for whom St. Camillus paid hourly wages and automatically deducted meal breaks between July 2016 and May 2024.”
The case has drawn attention to the larger risk for long-term care and healthcare employers who rely on automated or “hardcoded” meal deductions if employees are required (or even expected) to perform work duties during lunch, those deductions may violate wage and hour laws.
